Terms of Service
Important: These Terms form the agreement between the person or business subscribing to ServicePass (the Workshop, you or your) and ServicePass (we, us or our). By creating an account, starting a trial, subscribing to or using ServicePass, you agree to these Terms.
1. ServicePass
ServicePass is a hosted software service for maintaining and presenting vehicle service, repair, inspection and related workshop records. Features may include vehicle databases, condition reports, photographs, recommendations, customer-facing vehicle history pages, QR access, staff accounts, billing tools and other features we make available from time to time.
2. Accounts and authority
You must provide accurate account and workshop information and keep login credentials secure. If you create or manage a ServicePass workshop on behalf of a business, you confirm that you have authority to bind that business to these Terms. You are responsible for activity carried out through accounts belonging to your workshop, including staff accounts you authorise.
3. Trial and subscription
- Eligible new workshop accounts may receive a 14-day free trial.
- Unless otherwise shown before checkout, the standard ServicePass Workshop subscription is A$119 per workshop per month.
- Subscriptions are billed in advance and automatically renew for successive monthly billing periods until cancelled.
- Subscription payments are processed by Stripe. You authorise Stripe and ServicePass to charge the payment method associated with your subscription when payment becomes due.
- Applicable taxes, including GST where required, may be added or reflected in the price as required by law.
4. Cancellation
You may cancel through the billing portal made available in ServicePass. Unless we expressly state otherwise, cancellation takes effect at the end of the current paid or trial period and access continues until that date. We do not generally provide partial-period or change-of-mind refunds, but nothing in these Terms excludes any refund, remedy or consumer guarantee that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
5. Failed payments and suspension
If a recurring payment fails, ServicePass may provide a temporary grace period. The current system is designed to provide up to 7 days of billing grace after a failed payment before workshop management access is restricted. We may suspend or restrict paid features if payment remains outstanding. Historical customer-facing records may remain available where we consider this appropriate to preserve access to previously supplied vehicle history.
6. Pricing and plan changes
We may introduce new plans, optional features or change subscription prices. We will provide reasonable notice before a price increase applies to an existing paid subscription. A price change will not retrospectively alter charges already paid. Where required, you may cancel before the new price takes effect.
7. Workshop data and customer information
You retain your rights in the vehicle, customer and workshop content you enter into ServicePass. You give us a non-exclusive licence to host, copy, process, display and otherwise use that content only as reasonably necessary to provide, secure, maintain and improve ServicePass and to comply with law.
You are responsible for ensuring that information entered by your workshop is accurate, lawful and appropriate to collect. This includes obtaining any notices, permissions or consents required for customer personal information, vehicle photographs and other uploaded content.
8. Public vehicle pages
ServicePass may provide customer-facing vehicle history pages designed to be opened using a direct link or QR code without a workshop login. You are responsible for deciding what information is appropriate to include in records that may appear on those pages. You must not upload sensitive, confidential or unnecessary personal information to a public-facing vehicle record.
9. Photos and retention
ServicePass may compress uploaded images to improve performance and storage efficiency. Current service and repair photo functionality may apply a retention period of approximately 5 years to new service-record photographs, after which the photo file may be deleted while the underlying written service record is retained. Vehicle cover photos may be treated differently. Retention features may evolve as the service develops.
10. Acceptable use
You must not use ServicePass to break the law, infringe another person's rights, upload malicious material, attempt unauthorised access, interfere with the operation or security of the service, scrape or reverse engineer protected parts of the service, or use another workshop's data without authority.
11. Availability, changes and backups
We aim to provide a reliable service, but internet services can experience maintenance, outages, third-party failures and defects. We may change, update or discontinue features where reasonably necessary. You should maintain any records that your business is legally required to keep independently where relying solely on ServicePass would not satisfy your legal or regulatory obligations.
12. Third-party services
ServicePass relies on third-party infrastructure and services, including Firebase/Google Cloud for application infrastructure and Stripe for subscription billing. Your use of third-party functionality may also be subject to the relevant provider's terms and privacy practices.
13. Intellectual property
ServicePass, its software, branding, interface, designs and other materials supplied by us remain our intellectual property or that of our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use ServicePass for your workshop while your account is authorised and, where applicable, paid.
14. Liability
ServicePass is a record-management tool and does not replace a qualified mechanic's professional judgment, inspection, diagnosis or legal obligations. To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, loss of opportunity or loss caused by inaccurate workshop-entered data, unauthorised account use or circumstances outside our reasonable control.
Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including applicable consumer guarantees under the Australian Consumer Law. Where the law permits a remedy to be limited, our liability may be limited to supplying the relevant service again or paying the cost of having it supplied again.
15. Termination
You may stop using ServicePass and cancel your subscription at any time subject to the billing terms above. We may suspend or terminate an account for material breach, unlawful use, security risk, non-payment or where required by law. Where reasonably practicable, we will give notice and an opportunity to remedy a breach before termination.
16. Privacy
Our handling of personal information is described in the ServicePass Privacy Policy.
17. Changes to these Terms
We may update these Terms as ServicePass develops or legal requirements change. Material changes will be communicated through ServicePass or another reasonable method. The updated Terms will state their effective or last-updated date.
18. Governing law
These Terms are governed by the laws applicable in Australia and the Australian state or territory with jurisdiction over the relevant agreement. Each party submits to the courts and tribunals that have jurisdiction under those laws.
